1. Services

This Agreement outlines the goods and services to be provided by Canada First Inc. (“Canada First”, “we”, “us”, or “our”) to the Client (“you”, “your”, or “Client”) including the purchase, installation, and use of residential security and fortification services. This includes but is not limited to: door and window reinforcements, alarm system installation, connection to third-party monitoring, and optional related services.

This Agreement is subject to, and incorporates by reference, Canada First’s General Terms and Conditions, which are available online at General Terms page and Canada First’s Installation Terms and Conditions which are available online at Installation Terms & Conditions, both of which form an integral part of this Agreement. In the event of any inconsistency between this Agreement and the General Terms and Conditions or Installation Terms and Conditions, the terms of this General Terms and Conditions and the Installation Terms and Conditions shall prevail to the extent of the inconsistency.

THIS AGREEMENT TAKES EFFECT WHEN YOU CLICK THE “PROCESS PAYMENT” BUTTON BELOW OR BY ACCEPTING INSTALLATION OF THE GOODS (the “Effective Date”). BY CLICKING ON THE “PROCESS PAYMENT” BUTTON BELOW OR BY ACCEPTING INSTALLATION OF THE GOODS YOU:

  1. ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, THE GENERAL TERMS AND CONDITIONS, INSTALLATION TERMS AND CONDITIONS, AND PRIVACY POLICY;
  2. REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, POWER, AND AUTHORITY TO ENTER INTO THIS AGREEMENT AND, IF ENTERING INTO THIS AGREEMENT FOR AN ORGANIZATION, THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THAT ORGANIZATION; AND
  3. ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT PROCEED WITH PAYMENT AND DO NOT ACCEPT INSTALLATION OF GOODS. IF YOU DO NOT ACCEPT THESE TERMS, CANADA FIRST WILL NOT PROVIDE THE GOODS OR SERVICES.

2. Equipment Ownership and Responsibility

  • Ownership: Equipment is owned by the Client only once paid in full. If included in a financing plan or monthly bundle, ownership transfers only after all payments have been completed.
  • Maintenance: Clients are responsible for system upkeep, including repairs and testing. Client acknowledges and agrees that failure to maintain, repair and test equipment and systems may lead to equipment and system failure. Canada First is not liable for failures resulting from Client’s misuse, neglect, or non-maintenance.
  • Installation: Clients are responsible for compliance with the terms and conditions set forth in the Installation Terms and Conditions, prior to installation of any goods and prior to the commencement of any services.

3. Monitoring Services

  • Canada First contracts with third-party monitoring companies(the “Monitoring Services Provider”), currently Legacy Security Services, Inc.,who provides monitoring services. The monitoring services generally include the Monitoring Services Provider monitoring signals received from the Client’s electro-protective systems and responding thereto. This may include transmitting notification of the alarm to the appropriate authority(ies) and/or persons whose name(s) and telephone number(s) are set forth in this End-User Agreement and/or notification instructions, received by Monitoring Services Provider from time to time, unless in the opinion of the Monitoring Services Provider, there is cause to assume that a response condition does not exist.
  • Canada First reserves the right to change Monitoring Service Providers at any time, with no notice to the Client.
  • Canada First has no control over and is not responsible for police/fire/EMS or other emergency personnel response times and is not responsible for signal delays, wireless network performance, network quality, false alarms, or emergency failures.

4. System Limitations

  • The Client acknowledges and agrees that no system guarantees protection from break-ins, theft, injury, or property loss.
  • THE CLIENTFURTHER ACKNOWLEDGES AND AGREES THAT MONITORING SERVICES ARE DESIGNED TO REDUCE CERTAIN RISKS OF LOSS (SUCH AS BUSINESS OR PERSONAL LOSS, THEFT OF PROPERTY OR MONEY, PROPERTY DAMAGE, PERSONAL INJURY OR DEATH TO PERSON(S) OR OTHER LOSSES), AND THAT THERE IS NO SYSTEM OR MONITORING SERVICE THAT GUARANTEES THAT NO SUCH LOSS (SUCH AS BUSINESS OR PERSONAL LOSS, THEFT OF PROPERTY OR MONEY, PROPERTY DAMAGE, PERSONAL INJURY OR DEATH TO PERSON(S) OR OTHER LOSS) WILL OCCUR. THE CLIENT ACKNOWLEDGES AND AGREES THAT NEITHER CANADA FIRST NOR THE MONITORING SERVICES PROVIDER WILL BE LIABLE FOR ANY LOSS (SUCH AS BUSINESS OR PERSONAL LOSS, THEFT OF PROPERTY OR MONEY, PROPERTY DAMAGE, PERSONAL INJURY OR DEATH TO PERSON(S) OR OTHER LOSS), DUE DIRECTLY OR INDIRECTLY TO ANY OCCURRENCE OR CONSEQUENCES THEREFROM WHICH THE MONITORING SERVICES ARE DESIGNED TO REDUCE OR AVERT.
  • Without limiting the foregoing, Canada First, its vendors, contractors, and Monitoring Services Providers are not insurers and assume no responsibility for preventing loss or responding to emergencies.

5. Payment, Term, and Termination

  • The Client may enroll in a monthly, 1-year, 3-year, or 5-year term depending on the selected plan. The Client shall pay all invoiced amounts due to Canada First on receipt of Canada First’s invoice(s). Any amounts not paid on time will bear interest pursuant to Canada First’s General Terms and Conditions.
  • Early cancellation of this Agreement by the Client is not allowed. The Client acknowledges and agrees that the full contract amount is due and payable to Canada First regardless of Client’s usage.
  • Canada First may cancel or withhold any services at any time due to Client’s non-payment, with no requirement to provide notice to Client. Attempts will be made to notify the Client, but payment responsibility remains solely with the Client.
  • If the equipment has been fully paid for, the Client retains ownership of such equipment after service cancellation.
  • A transfer of service to a new homeowner is permitted only with Canada First’s written approval and execution of a new agreement with such homeowner.

6. Digital Acceptance and Electronic Signature

BY TYPING YOUR NAME AND CLICKING THE “PROCESS PAYMENT” BUTTON ON OUR WEBSITE OR DIGITAL FORM, YOU CONFIRM, ACKNOWLEDGE AND AGREE THAT:

  • YOU HAVE READ, UNDERSTOOD, AND ACCEPTED THIS AGREEMENT, THE GENERAL TERMS AND CONDITIONS, THE INSTALLATION TERMS AND CONDITIONS, AND PRIVACY POLICY IN FULL,
  • REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, POWER, AND AUTHORITY TO ENTER INTO THIS AGREEMENT AND, IF ENTERING INTO THIS AGREEMENT FOR AN ORGANIZATION, THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THAT ORGANIZATION; AND
  • ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT PROCEED WITH PAYMENT AND DO NOT ACCEPT INSTALLATION OF GOODS. IF YOU DO NOT ACCEPT THESE TERMS, CANADA FIRST WILL NOT PROVIDE THE GOODS OR SERVICES.
